These terms govern your use of Kwacha Kulture's platforms and services. Please read them carefully.

1. Agreement to these terms
These Terms of Service (the “Terms”) are an agreement between you and Kwacha Kulture B.V. (“Kwacha Kulture”, “we”, “us”), a company incorporated in the Netherlands. By accessing or using our websites, applications, and services (the “Platforms”), you agree to these Terms. If you do not agree, please do not use the Platforms.
2. Eligibility
You must be old enough to form a binding contract in your country and able to comply with these Terms. If you use the Platforms on behalf of an organisation, you confirm you are authorised to accept these Terms for it.
3. Your account
Some features require an account. You agree to provide accurate information, keep your credentials secure, and remain responsible for activity under your account. Tell us promptly if you suspect unauthorised use.
4. Acceptable use
When using our Platforms, you agree not to:
- Break the law or infringe the rights of others, including intellectual property rights.
- Post content that is unlawful, harmful, hateful, harassing, deceptive, or sexually exploitative.
- Impersonate others, or misrepresent your identity or affiliation.
- Attempt to disrupt, abuse, or gain unauthorised access to the Platforms or other users’ accounts.
- Use the Platforms to defraud others or facilitate illegal payments.
5. Your content
You keep ownership of the content you create and share. By posting content, you grant Kwacha Kulture a worldwide, non-exclusive licence to host, store, display, and distribute it as needed to operate and promote the Platforms. You are responsible for your content and confirm you have the rights to share it.
We may remove content or limit access that we reasonably believe violates these Terms or the law, or that may harm our users or Platforms.
6. Our intellectual property
The Platforms, including our names, logos, designs, and software, belong to Kwacha Kulture or our licensors and are protected by law. These Terms do not grant you any right to use our brand or materials except as expressly allowed.
7. Creators, earnings, and payments
Some Platforms let creators and vendors earn money. Where they do, applicable fees, revenue shares, and payout terms are made available within the relevant Platform. Payments and payouts are processed by third-party payment providers, and you agree to their terms where they apply. You are responsible for any taxes on amounts you earn.
8. Third-party services
Our Platforms may link to or rely on third-party services, such as payment providers. We are not responsible for those third parties, and your use of them is governed by their own terms and policies.
9. Disclaimers
The Platforms are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties that the Platforms will be uninterrupted, error-free, or fit for a particular purpose.
10. Limitation of liability
To the fullest extent permitted by law, Kwacha Kulture will not be liable for any indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of the Platforms. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold Kwacha Kulture harmless from claims arising out of your content, your use of the Platforms, or your breach of these Terms, to the extent permitted by law.
12. Suspension and termination
You may stop using the Platforms at any time. We may suspend or terminate access if you breach these Terms or to protect our users or Platforms. Provisions that by their nature should survive termination will continue to apply.
13. Changes
We may update the Platforms and these Terms over time. When we make material changes to these Terms, we will update the date above and, where appropriate, notify you. Continued use after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. Disputes will be subject to the competent courts of the Netherlands, unless mandatory law in your country of residence provides otherwise.
